1. Agreement to These Terms
These Terms & Conditions (the "Terms") are a binding agreement between you and Mercado Innovations, the company that operates WeSeeColor ("WeSeeColor," "we," "us," or "our"). They govern your use of the website at weseecolor.net, your member account, and every service we offer through the site, including our educational content, product evaluations, community submissions, newsletters, and access to telehealth services (together, the "Services").
By visiting the site, creating an account, or using any of the Services, you agree to these Terms and to our Privacy Policy, which is part of this agreement. If you do not agree, please do not use the Services.
2. Who We Are
WeSeeColor provides evidence-based education, community, and product-safety information centered on the skin and hair health of Black women. We exist because the dermatology industry was not designed with our community in mind, and we work with dermatologists, scientists, and community members to change that — through clear information, independent product evaluations, and collective advocacy.
3. Who May Use the Services
You must be at least 16 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Services, you represent that you meet these requirements and that any information you give us is accurate.
4. Health Information — Not Medical Advice
Everything published on WeSeeColor — articles, videos, product evaluations, community discussions, and expert interviews — is provided for general educational purposes only. It is not medical advice, and it is not a substitute for the professional judgment of a qualified clinician who knows your history.
Reading our content, submitting a form, or holding a member account does not create a doctor–patient or clinician–patient relationship between you and WeSeeColor or any expert who contributes to the site. Never disregard professional medical advice, or delay seeking it, because of something you read here.
Always consult a qualified healthcare professional before starting, stopping, or changing any treatment, medication, or product — especially if you are pregnant or nursing, have an existing condition, or take other medications. If you believe you have a medical emergency, call your local emergency number immediately.
5. Your Account
Some parts of the Services — requesting product reviews, recommending products, subscribing to topic updates, and taking part in member events — require a member account. When you register, we ask only for your name and your email address.
You agree to:
- provide accurate information and keep it up to date;
- keep your password confidential and not share your account with others;
- notify us promptly at contact@weseecolor.net if you suspect unauthorized use of your account.
You are responsible for activity that happens under your account. We may suspend or close accounts that violate these Terms (see Section 18). You may close your account at any time by emailing us from your registered address.
6. Your Privacy
We collect the minimum personal information the Services need — your name and email — plus the preferences you choose. We use it to operate your account, respond to your requests, and send you the communications you asked for. We do not sell your personal information to third parties. How we collect, use, and protect information is described in our Privacy Policy.
7. Product Information and Evaluations
Our product evaluations reflect our good-faith assessment of publicly available information — ingredient data, published research, regulatory records, and documented community experience — at the time of the evaluation. Because of that, you should understand what they are and what they are not:
- They are general, not personal. An evaluation does not account for your individual health status, allergies, sensitivities, or medications.
- They are a snapshot in time. Manufacturers change formulations, and new research emerges. Always check the label of the product in your hands.
- They are independent. Unless we clearly say otherwise, we are not affiliated with, sponsored by, or endorsed by the makers of the products we evaluate, and an evaluation is not an endorsement, a guarantee of safety or results, or an instruction to buy or avoid a product.
Decisions about what you put on your skin and hair are yours, made with your own judgment and, where appropriate, the advice of a qualified professional.
8. What You Submit to Us
The Services let you send us content — product recommendations, review requests, experiences you share through our forms, questions, and advocacy stories (your "Submissions"). Your Submissions remain yours. So that we can operate the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, and analyze your Submissions to run and improve the Services, to research and prepare product evaluations, and to advance our advocacy work — for example, by including your experience, without identifying you, in aggregated findings.
If we ever want to feature you by name — for instance, quoting your story in a campaign — we will ask you first.
When you submit content, you agree that it:
- is truthful to the best of your knowledge, and not misleading;
- is yours to share, and does not infringe anyone's rights or reveal another person's private or health information without their consent;
- is not unlawful, hateful, harassing, or an advertisement disguised as experience — if you have a financial relationship with a product or brand you write about, tell us.
We may review, decline, or remove Submissions at our discretion, including where we believe they are inaccurate, unsafe, or in breach of these Terms.
9. Acceptable Use
We built this platform for our community, and we protect it. You agree not to:
- use the Services for any unlawful purpose, or in a way that harms or exploits anyone;
- impersonate any person or organization, or misrepresent your affiliation with one;
- harass, abuse, or intimidate other members, contributors, or our team;
- probe, scan, or test the vulnerability of our systems, bypass authentication, or access data not intended for you;
- scrape, harvest, or bulk-download content or member information, or access the Services with automated tools without our written permission;
- interfere with the operation of the Services, including by introducing malware or placing unreasonable load on our infrastructure;
- use the Services to build a competing product database, or to train machine-learning systems on our content, without our written permission.
10. Telehealth and Practitioner Services
Where the Services connect you with dermatology practitioners — including through our telehealth portal and practitioner directory — those professional services are provided by independent, licensed practitioners or their practices, not by WeSeeColor. We do not practice medicine, and we are not a party to the clinician–patient relationship you form with a practitioner.
Practitioners are responsible for the care they provide, for their own licensure, and for their own terms and privacy practices, which apply to your relationship with them. Listing or connecting to a practitioner through the Services is not a guarantee of their availability, of insurance coverage, or of any particular outcome.
11. Emails and Communications
With an account, we send you service emails — such as verifying your address, resetting your password, and responding to requests you make. These are part of operating your account. Marketing and topic newsletters are sent only if you opt in, and every one of them includes a way to unsubscribe. You can also change your preferences on your account page at any time.
12. Fees
The Services described in these Terms are currently offered free of charge. If we offer optional paid features, their price, billing terms, and any additional conditions will be presented clearly before you pay, and no existing free feature will start charging you silently.
13. Our Content and Trademarks
The Services and their content — text, graphics, logos, illustrations, videos, product evaluations, and the software that runs them — are owned by us or our licensors and are protected by copyright, trademark, and other laws. WeSeeColor and the WeSeeColor logo are registered trademarks of Mercado Innovations. You may not use them without our prior written permission.
We grant you a limited, personal, non-exclusive, non-transferable license to access and use the Services and their content for your personal, non-commercial use. Sharing a link to our content is always welcome; republishing it, or using it commercially, requires our permission.
14. Third-Party Sites and Services
The Services contain links to, and embed functionality from, third parties — for example, video players, form tools, and the independent practitioners described in Section 10. We do not control third parties and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by that party's own terms and privacy policy.
15. Disclaimers
We work hard to keep the Services accurate, current, and available — and we do not promise perfection. To the fullest extent permitted by law, the Services and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that information on the site is complete or current at the moment you read it.
16. Limitation of Liability
To the fullest extent permitted by law, WeSeeColor, Mercado Innovations, and our officers, employees, contributors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or relating to your use of, or inability to use, the Services, even if we have been advised such damages are possible.
To the same extent, our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amounts you paid us for the Services in the twelve months before the claim arose, or (b) one hundred US dollars (US$100).
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
17. Indemnification
You agree to indemnify and hold harmless WeSeeColor, Mercado Innovations, and our officers, employees, and partners from claims, damages, and reasonable expenses (including attorneys' fees) arising from your Submissions, your misuse of the Services, or your breach of these Terms.
18. Suspension and Termination
You can stop using the Services, or close your account, at any time. We may suspend or terminate your access — with notice where practicable — if we reasonably believe you have violated these Terms, put other members or the Services at risk, or where we are required to by law. We may also modify or discontinue features of the Services as the platform evolves.
On termination, the license you granted us in Section 8 and Sections 13 through 21 survive. If your account is closed, we handle your personal information as described in the Privacy Policy.
19. Changes to These Terms
As the platform grows, we will update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where the change meaningfully affects registered members, notify you by email or on the site before it takes effect. Your continued use of the Services after a change becomes effective means you accept the updated Terms.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States of America, without regard to its conflict-of-laws rules. Before filing a claim, you agree to contact us at contact@weseecolor.net so we can try to resolve the dispute informally — most concerns can be sorted out this way. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.
21. General Terms
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Services, and supersede any prior agreements on that subject.
- Severability. If any provision of these Terms is found unenforceable, the rest remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary.
- No waiver. If we don't enforce a provision, that is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets, as described in the Privacy Policy.
- Notices. We may notify you via the email address on your account or by posting on the site.
